Caruncle Safaris (Pvt) Ltd T/A Rhino Safari Camp (herein referred to as the Company and the Camp) undertakes to provide such services including, but not limited to, transfers by various modes of transport, accommodation and various game viewing or other activities as detailed and agreed in correspondence with the relevant agent, guest or representative thereof. The cost of which is to be negotiated with the Company prior to arrival of the guests.
SPECIFIC ACCOMMODATION: While the Company will endeavour to ensure that all reserved accommodation is available as planned, it shall not be held responsible for a refund, either in the whole or part, if any accommodation or excursion is unavailable due to circumstances beyond its’ control. In such instances, the Company will make every effort to find a reasonable alternative for the guest within the Camp. If the guest is unable to use any service provided in the itinerary, no refunds will be due.
GUIDE REPLACEMENT: If a specified private guide is unable to lead a pre-scheduled safari due to illness or other factor, the Company reserves the right to substitute with another guide at its’ discretion.
WILD ANIMALS: Please be aware that guests will likely come into close contact with wild animals, whether out on activities or within the Camp environs. Attacks by wild animals are rare, but no safari into the African wilderness can guarantee that this will not occur. The Company cannot be held responsible for any injury or incident whilst staying at the Camp, or on a safari or whilst being transferred to or from the Camp. Please note that the Camp is not fenced and that wildlife frequently moves freely in and around the Camp during daylight and at night. Guests must always follow the safety instructions given the Camp’s staff with regards to moving to and from rooms or around the Camp environs and while on game viewing or other activities throughout the safari.
GAME VIEWING: No guarantees are given for sightings of specific species of wildlife or for what may be considered “good or poor game viewing”, as the animals inhabiting the areas you will visit are wild and therefore behave as such. The Company cannot be held responsible in any way for the presence or lack thereof of wildlife numbers, nor for the quality of game viewing on your safari.
INSURANCE: It is a condition of reservation that the sole responsibility lies with the guest to ensure that they carry the correct comprehensive travel, evacuation and medical insurance to cover themselves, as well as any dependants and travelling companions for the duration of their stay at the Camp. This insurance should include coverage in respect of, but not limited to, the following eventualities: cancellation or curtailment of the safari, emergency evacuation expenses, medical expenses, repatriation expenses, damage, theft or loss of personal baggage, money and goods. The Company will take no responsibility for any costs or losses incurred or suffered by the guest, or guest’s dependants or travelling companions, with regards to, but not limited to, any of the above mentioned eventualities. Guests will be charged directly by the relevant service providers for any emergency services they may require, and may find themselves in a position unable to access such services should they not be carrying the relevant insurance coverage or acceptable forms of payment.
MEDICAL INFORMATION / LIABILITY RELEASE: Participation on a safari requires that guests be in generally good health. All guests must understand that while a high level of fitness is not required, a measure of physical activity is involved in all African safaris and tours. It is essential that persons with any medical problems and related or other dietary restrictions, make them known to the Company well before arrival. Anti-malaria precautions should be taken, and these are the sole responsibility of the guest. Any required inoculations must be recorded by the guest’s health practitioner on a valid vaccination certificate which the guest must carry in his/her possession throughout the tour. The Company will not assume responsibility for the accuracy of any medical information given by its’ staff, and guests should consult their doctors or pharmacists for up to date requirements and personal recommendations.
TOUR CANCELLATION: The Company shall not be held responsible for occurrences that are beyond
its control, such as but not limited to strikes, wars, acts of God, acts of government or any other cause whatsoever, beyond its control, that may make operation of the tour impossible, illegal or inadvisable. **Only in instances in which a travel ban is issued by the guest’s relevant government authority after any payment has been made, will consideration be given to any refunds (in full or in part) of any payments received. Any refunds will be entirely at the discretion of the Company and will be the limit of the Company’s liability.**
The Company will not be responsible for any expenses incurred by guests in preparing for the safari, including non refundable or penalty-carrying airline tickets, special clothing, visa or passport fees or other tour-related expenses.
LIMITATIONS OF LIABILITY: This section defines the Company’s responsibility with respect to all safaris booked for its’ guests, including extensions and independent arrangements. Please read it carefully.
Caruncle Safaris (Pvt) Ltd trading as Rhino Safari Camp (the Company), and any of its’ associated or subsidiary companies, subcontractors, agents, shareholders and employees thereof, give notice that they assume no responsibility, howsoever caused, excepting its’ own gross negligence or wilful misconduct, for injury, death,loss or damage to person or property, delay or change in air or other services, howsoever caused, irregularity, inconvenience or additional expenses in connection with any service resulting directly or indirectly from: defect of any vehicle or boat, act of God, act of war, insurrection, revolt, terrorism, government restrictions and regulations, or other civil uprisings or disturbances, military action, quarantines, strikes, weather, sickness, wars, detention, annoyance, delays, thefts, pilferage, force majeure, wild animals, failure of any means of conveyance to arrive or depart as scheduled, governmental or other travel advisories, discrepancies or changes in transit, hotel and other services over which it has no control, occurring in either the country of origin, destination or through passage, or through the acts or default of any third party company or persons engaged in conveying the passengers or in carrying out the arrangements of the tour. The Company will not be held responsible and accepts no responsibility for any loss or damage to luggage or other personal effects, such as but not limited to cameras, binoculars, telescopes, watches, hearing aids and glasses, before, during, or after the guests stay.
Upon advancement of a deposit to the Company, or its’ nominated agent or subcontractor, in respect of partial or full payment for accommodation, transfers or other services to be rendered by the Company or its’ nominated agent or subcontractor, the depositor acknowledges that he/she has read and understands the above recited terms and conditions, and agrees to be bound by them.
The Company or its’ nominated agent or subcontractor reserves the right to accept or decline any individual from participating on any of its’ safaris or activities for any reason. The Company will not discriminate against any individual because of race, religion, sex, sexual preference or nationality.
LITIGATION: Any dispute that may arise concerning the interpretation of this contract or the execution of the services mentioned above, that cannot be resolved amicably, shall be settled by the magistrates court of Zimbabwe.
RESERVATIONS & PAYMENT: No provisional reservation, whether for transport, accommodation, tours or other services, shall be confirmed, until the Company has received a 30% non-refundable deposit.
Full pre-payment of all services is required 60 days prior to arrival.
Reservations made within 6 weeks of departure require full payment and proof of payment provided to the Company within 48 hours of the provisional reservation, thereafter the Company reserves the right to cancel any or all of the services booked.
Payments are to be made by cash or by bank transfer, to the bank account as named by the Company. Payments by credit or debit cards are NOT available at present. Please note that the cost of all bank charges and commissions must be borne by the depositor. The Company must receive the total amount shown as due on our invoice and any shortfalls will be collected from the guests prior to departure.
CANCELLATION POLICY: Cancellation by the Guest will only be valid if received by the Company in writing and the following cancelation fees, calculated as from date of receipt of notice, shall apply:-
60 or more days prior to travel – 30% loss of total cost of the invoice (i.e., the non-refundable deposit 30-60 days prior to travel – 50% loss of total cost of the invoice
30 or less days prior to travel – 100 % loss of total cost of the invoice
Please note, if a confirmed reservation is cancelled after the due date for full payment, a cancellation charge will be levied.
Should the guest/s fail to join a tour or safari, or join it after departure, or leave it prior to its completion,
no refund will be made. (Please note that if the reason for cancellation falls within the terms of any holiday insurance policy, which the guest/s hold, then such charges indicated above will normally be refunded by the insurance company subject to the terms of their insurance policy.)
The Company reserves the right to cancel all confirmed reservations should full payment not be received 60 days prior to arrival and the 30% deposit paid to secure the booking will be forfeited.
